How do I get a legal heir certificate in Karnataka?
Karnataka does not issue a document called a legal heir certificate. The equivalent is the Surviving Family Member Certificate, applied for through the Nadakacheri portal or at an Atalji Janasnehi Kendra, and signed by the Tahsildar. There is a second, different document called Vamsha Vruksha — a family tree certificate — and families routinely apply for the wrong one of the two.
At a glance
- Called
- Surviving Family Member Certificate · Vamsha Vruksha, for the separate family-tree certificate
- Issued by
- Tahsildar, through the Nadakacheri (Atalji Janasnehi Kendra) centres
- Apply at
- Nadakacheri
- Reported cost
- Nominal — a government charge in the tens of rupees, with an extra charge if you want it posted
- Reported time
- Commonly reported at about a week when filed online with complete documents, longer at a counter
Cost and time are what families report, not figures the state publishes as a commitment. The postal delivery charge is separate from the service fee and is often quoted as a single number online, which makes published figures look inconsistent. Confirm both at the Nadakacheri counter.
What you will need
- Death certificate of the deceased
- Aadhaar of the applicant and of each surviving family member being listed
- Address proof of the deceased
- A declaration naming every surviving family member
- Ration card, where it records the family together
What is different in Karnataka
Surviving Family Member Certificate and Vamsha Vruksha are not interchangeable. The first lists who survived the deceased; the second maps a family tree across generations, and is usually wanted for ancestral property rather than for a bank claim. If an institution has asked you for proof of who the heirs are, the Surviving Family Member Certificate is almost always the one.
Nadakacheri is the Revenue Department's own portal and the Atalji Janasnehi Kendra counters are the same system staffed in person. Filing at a counter does not put you in a different queue.
Karnataka is one of the more reliable states for the online route actually working end to end, so it is worth trying before booking time off to queue.
Will this be enough, or do you need a court?
A heir certificate is a revenue document, not a court order, and for most families it is enough. Under the RBI (Settlement of Claims in respect of Deceased Customers of Banks) Directions, 2025, every bank has to fix a threshold below which it settles a deceased customer’s account without sending the family to court — and that threshold cannot be lower than ₹15 lakh at a scheduled bank, or ₹5 lakh at a co-operative bank.
That is the regulatory floor, not a promise: a bank may set its limit higher, and the figure it applies to your case is the one its own policy names. Ask the branch in writing what their limit is before you assume you need a court.
Below the limit, the bank works from a claim form, the death certificate, identity proof, an indemnity bond and no-objection letters from the heirs who are not claiming. Above it, it can require a succession certificate — a civil court petition that realistically takes six months or more. That gap is the whole reason it is worth asking before you file anything.
Common questions
- What is a legal heir certificate called in Karnataka?
- Karnataka does not issue a document called a legal heir certificate. The equivalent is the Surviving Family Member Certificate (Vamsha Vruksha, for the separate family-tree certificate), issued by the Tahsildar, through the Nadakacheri (Atalji Janasnehi Kendra) centres. Ask for it by that name — asking for a legal heir certificate is why families are turned away at the counter.
- Who issues the surviving family member certificate in Karnataka?
- The Tahsildar, through the Nadakacheri (Atalji Janasnehi Kendra) centres. Applications are made through Nadakacheri, or in person at the relevant office.
- How long does a legal heir certificate take in Karnataka, and what does it cost?
- Commonly reported at about a week when filed online with complete documents, longer at a counter. Nominal — a government charge in the tens of rupees, with an extra charge if you want it posted. Both are reported figures rather than a published guarantee. The postal delivery charge is separate from the service fee and is often quoted as a single number online, which makes published figures look inconsistent. Confirm both at the Nadakacheri counter.
- Will a Karnataka surviving family member certificate be enough to claim a bank account?
- Often, yes — below the threshold the bank has fixed, a heir certificate with an indemnity bond and no-objection letters from the other heirs is usually accepted, and no court order is needed. Above that threshold the bank can insist on a succession certificate from a civil court. Ask the branch in writing which applies to your case before starting anything.
