How do I transfer my father’s house after his death?

A house is not released the way a bank account is. You apply for mutation of the revenue or municipal record on a death certificate and a legal heir certificate (or a probated will), and every heir either joins the record or releases their share. A succession certificate does not transfer land. Mera Hissa prepares the financial-asset papers; mutation of a house is a local revenue filing.

Mutation is the name of the step

The municipal corporation or the tehsil changes the name in the property tax or khata / record-of-rights. That is mutation. It is not a sale and it is not a court decree by itself.

If there is a will covering the house, many offices want probate before they mutate. If there is no will, they want the local legal heir certificate and an affidavit that lists every heir.

Do not mix this file with the bank file

The bank wants its own claim form and, sometimes, a succession certificate for a large un-nominated deposit. The tehsildar wants a legal heir certificate. Filing the court case “for everything” is how families lose a year.

If you also have accounts, shares or a policy, run the free check for those. The house still goes to the local revenue office.

Common questions

Can I sell the house with only a legal heir certificate?
Buyers and registrars usually want every heir on the sale deed, or a release from those who are not selling, plus mutation in the seller’s name. A certificate alone is rarely enough to pass title.
