One holder of our joint account has died. Who owns it now?

It depends on the operating instruction on the account. With "either or survivor" or "former or survivor", the surviving holder continues to operate the account and receives the balance on the death certificate, with no claim process. With an account operated "jointly", there is no survivorship, and the deceased's share is claimed by their legal heirs. In every case, though, survivorship decides who the bank pays — not who ultimately owns the money, which is a question of succession.

The three operating instructions

Either or survivor: either holder may operate; on one death, the survivor continues, and the bank pays the survivor on the death certificate. Former or survivor: only the first-named holder operates during their lifetime; on their death, the survivor takes over. Jointly: both must sign; on one death, the survivor cannot operate alone, and the balance is paid to the survivor together with the deceased's legal heirs, or on their NOCs.

The Reserve Bank directs banks to honour survivorship instructions without insisting on a succession certificate, so a survivor who is refused should escalate.

Operating is not the same as owning

Survivorship is a payment mechanism. It lets the bank hand the money to the surviving holder without adjudicating who is entitled to it. Whether the survivor keeps it depends on whose money it was and on the succession law that applies — a joint account between husband and wife is usually the wife's in practice, but a joint account between a father and one son is not the son's alone if he has siblings. Where it matters, record the intended position in a family settlement rather than assuming.
