My brother died unmarried. Who gets his money?
For an unmarried Hindu man with no children, the answer turns on whether his mother is alive. She is a Class I heir and, with no widow or children to share with, she takes everything. If she has died, his father inherits as the first Class II heir. Only if both parents are gone does the estate pass to his brothers and sisters, who share it equally. Siblings are further down the list than most families expect.
The order
Section 8 of the Hindu Succession Act gives a man's estate first to his Class I heirs — widow, children, and mother. An unmarried man with no children has one possible Class I heir, his mother, and she takes the whole estate. Note that his father is not a Class I heir. If the mother has died, the estate goes to the Class II heirs in order of entry, and the first entry is the father alone. Only when the father has also died does the second entry apply: brothers, sisters, and the children of a deceased child — who share equally.
What this means for a claim
A brother handling the paperwork usually assumes he and his siblings are the heirs. If either parent is alive, that is wrong, and a claim filed in the siblings' names will be rejected — or worse, paid and later disputed. The parent is the claimant, and the siblings sign no-objection letters or act on the parent's behalf. A nominee on any of his accounts collects for whoever the heir is; the nominee does not become the owner.
A will, or another community
A valid will overrides all of this. If your brother was Christian, the Indian Succession Act applies and parents and siblings are treated differently.
